Retained by Brown Rudnick, acting on behalf of its client Joseph Wortley, MM Dillon acted as a qualified expert witness to address certain issues in the US Bankruptcy Court Southern District of Florida Broward Division. The Global Energies case was a remand from the US Court of Appeals for the Eleventh Circuit for an unwind of a bad faith bankruptcy. The work focused upon the process and conduct of the parties that predated bankruptcy. It determined the valuation of the shares owned by the Plaintiffs in Global Energies and ultimately the damages caused to the appellant. The case involved one of the leading reversals of a 363 sale that was completed in bad faith.
